Partner Privacy Policy

1. General Provisions

This Privacy Policy (the “Policy”) describes how NObal LLP (“NObal”) collects, uses, stores and protects the personal data of representatives of Partners when they register for and use the NObal service (the “Service”).

This Policy applies to individuals acting on behalf of a Partner, including individuals who register the Partner, use the Partner’s account or otherwise interact with NObal.

The commercial terms of cooperation between NObal and the Partner are governed separately by the Public Offer for Partners. This Policy governs matters relating to the processing of personal data.

Personal data is processed in accordance with the applicable requirements of the legislation of the Republic of Kazakhstan.

3. What Data We May Process

Depending on the nature of your interaction with NObal, we may process:

the surname, first name and patronymic of the Partner’s representative;
telephone number;
email address;
information provided during the Partner’s registration and verification;
information contained in documents submitted to NObal by you or the Partner;
information contained in requests and correspondence with the support service;
information regarding the use of the account;
the date and time of use of the Service;
technical data, including the IP address and information about the device, browser and session.

NObal also processes information relating to the Partner itself where such information is necessary to provide the Service, including the Partner’s name, BIN/IIN, business location address, bank details and other registration details.

Such information constitutes personal data only to the extent that it relates to an identifiable individual.

4. Where We Obtain Data

We may obtain data:

directly from you;
from the Partner on whose behalf you act;
from documents and information provided during registration or use of the Service;
automatically when you use the website, personal account or other parts of the Service;
from publicly available sources and accessible business registers where necessary to verify the Partner;
from our contractors and service providers to the extent necessary for the operation of NObal.

5. Why We Process Data

We may use personal data for the following purposes:

registering and verifying the Partner;
creating an account and providing access to it;
providing and supporting the Service;
performing the Public Offer;
communicating with the Partner;
preparing necessary documents;
reviewing requests, complaints and disputed matters;
preventing fraud and misuse;
ensuring the security of the Service and accounts;
diagnosing technical errors and improving the operation of the Service;
complying with the requirements of the legislation of the Republic of Kazakhstan;
protecting the lawful rights and interests of NObal, Partners, Users and third parties.

Personal data is collected and processed on the basis of the data subject’s consent or on other grounds provided for by the legislation of the Republic of Kazakhstan.

6. Who We May Share Data With

We do not sell personal data to third parties.

Where necessary for the operation of NObal, personal data may be disclosed, to the extent required, to:

IT, hosting and cloud infrastructure providers;
software providers;
email, notification and technical support services;
banks and financial institutions;
accounting, legal, audit and other professional advisers;
contractors responsible for the security and operation of the Service;
government authorities, courts and other authorised persons in cases provided for by the legislation of the Republic of Kazakhstan.

Personal data is disclosed only to the extent necessary for the relevant purpose.

7. Data Storage and Transfer

We retain personal data only for as long as necessary to achieve the purposes for which it was collected and for any periods required by the legislation of the Republic of Kazakhstan.

After cooperation with a Partner has ended, certain data may continue to be retained where necessary to comply with legal, accounting or tax requirements, resolve disputes or protect NObal’s lawful rights.

Third-party infrastructure and software solutions, including solutions provided by foreign companies, may be used for the operation of the Service.

The transfer and storage of personal data using such services are carried out in compliance with the applicable requirements of the legislation of the Republic of Kazakhstan.

Once the purposes of processing have been achieved and mandatory retention periods have expired, personal data is deleted, destroyed or anonymised in accordance with the established procedure.

Personal data is stored in a database and/or digital object located within the territory of the Republic of Kazakhstan in accordance with the requirements of the legislation of the Republic of Kazakhstan.

8. How We Protect Data

NObal takes the necessary organisational and technical measures to protect personal data against:

unauthorised access;
unlawful use;
alteration;
disclosure;
destruction;
loss;
other forms of unlawful processing.

Access to personal data is granted only to employees and contractors who require such access in order to perform their respective duties.

However, no method of transmitting information over the internet or data storage system can guarantee absolute security.

9. Cookies and Technical Data

When you use the NObal website and web interfaces, cookies and similar technical technologies may be used.
